1. What we are
Liberty Gun Trader is an online venue where independent buyers, individual sellers and licensed dealers list, buy and sell items. We are not the seller of items listed by users, we do not take possession of listed items, and we are not a party to the sale between buyer and seller. Payments are processed by third parties (for example GunTab escrow or a seller’s Authorize.net account) under their own terms.
2. Eligibility and accounts
- You must be at least 18, legally able to enter contracts, and not prohibited by law from possessing the items you buy or sell.
- Provide accurate information and keep your password secure. You are responsible for activity on your account.
- FFL accounts must hold a current federal firearms license and may be asked to verify it at any time.
- Individual accounts are for personal, non-commercial sales and are limited in the number of active listings.
3. Compliance with law
Buyers and sellers are solely responsible for complying with all federal, state and local laws. Firearms sold through the marketplace must be transferred through a licensed FFL dealer, including any required background check. Do not list or sell any item you may not lawfully sell, and do not buy any item you may not lawfully possess.
4. Listings
- Listings must describe the actual item accurately, with honest condition and real photos, in the correct category.
- Prohibited: illegal items or services, items you do not have the right to sell, stolen property, items with altered or removed serial numbers, NFA items not transferred through proper channels, misleading or duplicate listings, and listings designed to avoid lawful procedures.
- We may edit categories, remove listings, or suspend accounts that violate these terms.
5. Auctions, offers and purchases
- A bid is a binding commitment to buy at the winning price if you win. Our system bids automatically on your behalf up to the maximum you enter, only as much as needed to keep you in the lead.
- Auctions may have a reserve price; if the reserve is not met the seller is not obligated to sell. Bids in the final minutes may extend the end time.
- Accepted offers and Buy Now purchases are binding. Winning bidders and buyers must complete payment within the time shown on the order, or the order may be cancelled and the item relisted.
- Sellers must honor completed sales at the listed or winning price and ship or transfer as described.
6. Payments, shipping, returns and disputes
Payment options are set by each seller. Escrow payments through GunTab are governed by GunTab’s terms and dispute process. Card payments go to the seller through the seller’s processor; refunds and returns are handled by the seller according to the policy stated in the listing. Sellers are responsible for lawful shipping to the buyer’s chosen FFL. We encourage buyers and sellers to resolve problems directly and may, but are not required to, help mediate.
7. Conduct
Do not harass, threaten or defraud other users, scrape the site, interfere with its operation, manipulate bids (including bidding on your own items), or use the site to arrange transactions that avoid required background checks or other legal requirements.
8. Disclaimers and limitation of liability
The site is provided “as is.” We do not guarantee the quality, safety, legality or accuracy of listings or the ability of users to complete transactions. To the fullest extent permitted by law, Liberty Gun Trader is not liable for indirect, incidental or consequential damages, or for losses arising from transactions between users.
9. Changes and termination
