**Liberty Gun Trader User Agreement**

This User Agreement (“Agreement”) is entered into by and between you (“User” or “Member”) and Liberty Gun Trader (“Company,” “we,” “us,” or “our”). By accessing or using our website (the “Site”) or subscribing to our membership service, you agree to be bound by the terms and conditions outlined in this Agreement. If you do not agree to this Agreement, you may not use the Site or services.

 

  1. “Eligibility”

You must be at least 18 years of age and legally permitted to purchase and/or sell firearms in accordance with all applicable laws and regulations in your jurisdiction to use the Site. By using this Site, you represent and warrant that you meet these eligibility requirements.

  1. “Nature of Services”

Liberty Gun Trader serves as an online platform that connects sellers of firearms and related accessories with potential buyers. The Company does not sell, manufacture, ship, or handle any products listed by users on the Site. All transactions, communications, and agreements regarding the sale or purchase of firearms occur directly between the sellers and buyers.

  1. “Membership and Fees”

Sellers are required to pay a monthly membership fee to access seller features of the Site. Payment of fees will be processed through third-party payment processors, which are not owned or controlled by Liberty Gun Trader.

  1. “Third-Party Services”

Liberty Gun Trader integrates third-party services for payment processing and shipping facilitation. These third-party companies operate independently of Liberty Gun Trader, and we make no warranties or representations regarding their services.

 

By using our Site, you acknowledge and agree that Liberty Gun Trader is not liable for any issues, damages, or disputes arising from services provided by third-party vendors, including but not limited to payment processing and shipping. Any issues related to such services must be resolved directly between you and the respective third-party provider.

  1. “User Responsibilities”

You agree that you are solely responsible for ensuring that your use of the Site and any transactions conducted through it comply with all applicable federal, state, and local laws. This includes but is not limited to background checks, legal ownership of firearms, ammo, accessories, proper licenses, and any other legal requirements associated with the buying or selling of firearms and related articles.

  1. “Prohibited Activities”

– Engaging in illegal transactions or violating any applicable laws, including firearms laws.

– Listing products or engaging in transactions that involve stolen, prohibited, or counterfeit firearms or accessories.

– Using the Site to engage in any form of fraudulent, deceptive, or misleading behavior.

– Providing false or misleading information in your profile or listings.

 

  1. “Disclaimers”

Liberty Gun Trader provides the Site on an “AS-IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Site will be free from errors, interruptions, or security breaches.

 

  1. “Indemnification”

You agree to indemnify, defend, and hold harmless Liberty Gun Trader, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees and court costs) arising out of or in any way connected with:

 

– Your access to or use of the Site.

– Any claims, disputes, or legal proceedings arising from the purchase, sale, or use of any firearm or related accessory through the Site.

– Your violation of any applicable law or regulation, including but not limited to federal, state, or local firearms regulations.

– Any transaction or dispute between you and a third-party service provider, including but not limited to payment processors and shipping companies.

– Any breach by you of this Agreement or any warranty or representation you make under this Agreement.

 

  1. “Limitation of Liability”

To the maximum extent permitted by law, Liberty Gun Trader will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from or relating to this Agreement, your use of the Site, or any products sold through the Site, including but not limited to damages for lost profits, loss of data, or other intangible losses.

 

  1. “Termination”

Liberty Gun Trader reserves the right, in its sole discretion, to suspend or terminate your membership or access to the Site at any time for any reason, including but not limited to a breach of this Agreement or violation of any applicable law.

 

  1. “Governing Law”

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles.

 

  1. “Dispute Resolution”

Any disputes arising out of or related to this Agreement or the Site shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Pensacola, Florida, and the decision of the arbitrator shall be final and binding on both parties.

 

  1. “Amendments”

Liberty Gun Trader reserves the right to modify or amend this Agreement at any time. Any changes will be posted on the Site, and continued use of the Site following any changes constitutes acceptance of the revised terms.

 

  1. “Contact and Communication”

By providing your contact information (including but not limited to email addresses, phone numbers, or mailing addresses) through the Site, you consent to being contacted by Liberty Gun Trader or other users of the Site regarding transactions, services, or any other relevant communications. You agree that we, or any authorized third party, may contact you using any of the contact information you provide for the purposes of customer service, transactional updates, or marketing messages.

You may opt-out of certain communications by following the instructions provided in those communications or contacting us directly. However, we may still send you essential transactional or administrative messages, from which you cannot opt out.
